AGRIBYTES dba WEBSITES MADE WITH LOVE INC. (“Company”, “we”, “us”, “our”, “WMWL”) is a web design and online marketing company based in Parksville, British Columbia that provides services including website design, digital marketing, Google ads, Facebook ads, search engine optimization, and website maintenance, including by providing the Intellectual Property (as defined below), and the Website (as defined below), together, the “Services”.

We operate and provide the products, services, information, content, data, and Intellectual Property at our website at www.agribytes.ca (the “Website”).

This Privacy Policy interacts with, and is subject to, and, where applicable, User is subject to and agrees to our Terms of Service and our Master Services Agreement.

Certain defined terms in this Privacy Policy may be found and defined in those agreements. Please review those agreements in conjunction with this Privacy Policy.

For greater clarity, User acknowledges and agrees that any of the following actions shall clearly evidence, constitute, and denote User’s express consent and agreement to this Privacy Policy, and any applicable agreement listed above, including when User checks a checkbox next to a form or Interactive Function (as defined in our Terms of Service), User otherwise interacts with any Interactive Function, User registers for the Website, User enters into a written agreement with WMWL, User submits any Personal Information or other personal data to the Website or to WMWL, User publishes or submits a User Submission (as defined in our Terms of Service) to the Website or WMWL, or User engages in continuous use of the Website.

Your continued use of the Website or WMWL’s Services, including on third-party sites, apps, or channels, including after we make changes, indicates that you accept and consent to those changes. It is your responsibility to check this Privacy Policy periodically for updates.

CONSENT TO MAIL LIST & CASL COMPLIANCE

Without limiting anything in this Privacy Policy, by using or accessing the Services, Intellectual Property, or Website, User expressly agrees and provides consent to WMWL to send, distribute, or otherwise transmit to you any Commercial Electronic Message (CEM) or other communications or notifications, including for commercial and other promotional purposes; and you agree to be added to our mail list until and when you provide us written notice that you wish to unsubscribe in accordance with the notice provision at the end of this Privacy Policy; and you agree that you otherwise provide us implied consent by virtue of the relationship between you and us and/or your posting or making available your information online unaccompanied by a statement that you do not wish to receive CEMs.

RECORDED MEETINGS

User provides consent to have any calls or virtual meetings between WMWL and User recorded and stored in WMWL’S system, to be used to help deliver the Services and for the purposes stated herein.

AGE RESTRICTIONS

Use of and access to the Website is not intended for individuals under 18 years of age. No one under age 18 may provide any information to or on the Website. We do not knowingly collect personal information from individuals under the age of 18. If you are under 18, do not submit any information to the Website, use any of the Interactive Functions of the Website, or submit any User Submissions to the Website.

If we learn we have collected or received personal information from an individual under the age of 18 without verification of parental consent, we will delete that information. GEOGRAPHIC RESTRICTIONS

WMWL is in British Columbia, Canada and the Website and Services are offered only for access and use in British Columbia, Canada. The Website is not intended for use in any jurisdiction where its access and use is not permitted. WMWL does not currently have sufficient capabilities to determine where a User is located, including to prevent User’s access to the Website or certain features or functionality of the Website based on their geographic location.

If you access the Website from outside British Columbia, Canada, you do so at your own risk and you are responsible for compliance with local laws of your jurisdiction. You must immediately stop using the Website if your access and use of it as it is offered by WMWL is prohibited under your local laws or regulations and in no way shall WMWL be responsible or liable for your unauthorized or unlawful use of the Website or the Services.

Business and Usage Information, including as pertaining to User’s posting of User Submissions, User’s interactions with content, features, functionality, products, and services on the Website, User’s interactions with Interactive Functions, User’s Confidential Information (as defined in our Master Service Agreement), and User’s business information as provided to WMWL or as contained in a User Submission or as otherwise uploaded or published on or to the Website.

Direct interactions with you when you provide it to us, for example, by submitting or publishing a User Submission, including through forms, or corresponding with us by phone, email, social media, or otherwise.

Facebook Lookalike Audience. Facebook Lookalike Audience is an advertising and behavioral targeting service provided by Facebook, Inc. that uses data collected through Facebook Custom Audience in order to display ads to Users with similar behavior to Users who are already in a Custom Audience list on the base of their past use of this Website or engagement with relevant content across the Facebook apps and services.

Google Ad Manager. Google Ad Manager is an advertising service provided by Google LLC that allows us to run advertising campaigns in conjunction with external advertising networks that we, unless otherwise specified in this document, have no direct relationship with.

Google Analytics. Google Analytics is a web analysis service provided by Google LLC (“Google”) that utilizes the data collected to track and examine the use of this Website, to prepare reports on its activities, and share them with other Google services.

Google Analytics 4. Google Analytics 4 is a web analysis service provided by Google LLC or by Google Ireland Limited. Google utilizes the Data collected to track and examine the use of this Website, to prepare reports on its activities and share them with other Google services. Google may use the data collected to contextualize and personalize the ads of its own advertising network.

WordPress Stats. WordPress Stats is an analytics service provided by Automattic Inc.

Dropbox. Dropbox is a service to save and manage backups provided by Dropbox Inc.

STORAGE AND TRANSFER OF YOUR PERSONAL INFORMATION

Where possible and practicable, we use our best efforts to process and store your personal information and other data in Canada. We use Hosting Nation to host our servers and data, which stores your data in Canada, but may sometimes require your data to be located outside of Canada. In those instances, different privacy laws may apply that may or may not be as comprehensive as Canadian law. In these circumstances, the governments, courts, law enforcement, or regulatory agencies of that country may be able to obtain access to your personal information through the laws of the foreign country.
